In the following Terms and Conditions, any use of ‘we’, ‘our’ or ‘us’ refers, at all times, to ‘Bluestone Furniture and Upholstery Pty. Ltd. Any use of ‘you’ or ‘your’ refers, at all times, to our users and customers.
Your use of Bluestone Furniture and Upholstery Pty. Ltd.'s custom furniture design and bespoke upholstery service is contingent upon your acceptance of these Terms and Conditions. We encourage all users to read the following carefully. Once you engage with our service, you will be assumed to have read, understood and agreed to our terms and are therefore bound by them, at all times.
Our Service
At Bluestone Furniture and Upholstery, we provide our customers with custom made, unique and quality pieces of furniture. We create our beautiful pieces by sourcing the finest of natural materials, and pairing these with high levels of craftsmanship, to produce individual pieces that you will love for years to come. Our services also include restoration or reupholstery of any existing furniture.

We reserve the right to make modifications to our service at any time, without notice or consequence. Furthermore, we reserve the right to refuse service to any person that we deem as having misused our service or used it in an illegal manner or for an otherwise prohibited purpose.
Orders
To make an order for upholstery or to design a custom piece, Bluestone Furniture and Upholstery must receive this order in writing with all information clearly stated. We are happy to work from photos or diagrams, the more information you provide the better we can achieve your end result.
Alternatively, we invite you to contact us by phone or email or make an appointment to come and visit us at our factory to discuss your design and furniture. Our staff will assist you in creating the perfect piece for your style and needs. Any changes to orders must be provided in writing.
Products and design
We pride ourselves on the individuality of our products and designs. We can custom make a piece to suit your style and taste. Any design time will be charged accordingly.
The technical drawings of any piece that is an original design by Bluestone Furniture and Upholstery remains our property at all times. If we create a custom piece for you, we simply grant you ownership of that piece. No rights to the design or technical drawings will transfer to the customer.
Every piece we make is perfectly unique. This is one of the best things about our furniture - no two pieces are the same. If you are considering one of our pieces but are concerned or unsure about the possible differences in materials, we will be happy to talk you through the materials used and some of their natural characteristics, to assist you in making your final decision.
Payment
Customers will be provided with a quote for their product and delivery during the consultation process.
For your convenience, we accept several methods of payment, including cash, EFTPOS, credit card or direct deposit. Company or personal cheques may also be accepted if arranged prior to payment and delivery.
Customers are liable to pay any ancillary fees associated with their chosen form of payment, for example, bank charges or fees.
Deposit and final payment
You will be provided a quote for your pieces, plus any relevant delivery charges, before confirming your order.
Upon placing your order, by approving the quote online or via email, we require a minimum 50% deposit of the full amount of the quote. The remaining balance is to be paid by the final installation day.
Please keep in mind that lead times provided are always relative to the payment date of your deposit, as the deposit is often used to secure materials, however this proviso holds regardless of your providing any materials yourself.
We welcome you to make an appointment to visit our workshop and view your piece prior to delivery should you wish to inspect the piece before making payment. Failure to pay the balance prior to delivery may result in cancellation of the delivery until payment is made and storage fees may apply.
Late payments will incur a 5% surcharge, which will be added to the total balance due upon delivery.
Delivery
Customers will be provided with a quote for delivery based on distance from our factory and the size of the order. We may also take into account variables such as access to your property or any stairs/lifts to be negotiated in the delivery process. Delivery fees will be added to your order total.
Access details must be provided prior to the day of delivery. If you have not advised Bluestone Furniture and Upholstery of issues with the access and we are unable to fit the furniture into your premises safely an additional charge will be added to your invoice.
We request all customers to prepare for the delivery by clearing the path of access and removing any furniture or objects that may get in the way of the delivery prior to our arrival.
Care instructions
We use a lot of beautiful natural materials in our furniture, which need love and care. In order to retain the quality and appearance of your piece, and to ensure that your warranty remains valid, please adhere strictly to the following care instructions:
- All fabric care instructions must be followed carefully to avoid damage to your custom made or upholstered furniture.
- Do NOT place furniture in direct or diffused sunlight, or under a heating or cooling source i.e., heaters and air conditioners, as this will cause structural movement.
- Do NOT apply hot or wet items directly onto finished surfaces as they can leave marks, which may not be able to be removed.
- Do NOT drag or push your furniture. Always use proper lifting techniques if you need to move your furniture to ensure that no pressure is placed on the joints - improper pressure may result in bends or breaks in the joinery. If you are unsure about the correct way to move your furniture, please contact us and we will assist you.
- Contact with acidic liquids such as lemon juice, nail polish remover and other similar products can result in damaging the finish on your furniture, use of such products on your furniture is NOT recommended.
- Do NOT use harsh cleaning products to clean your furniture as this may damage the furniture.
- Only use a damp natural fibre cloth to clean your furniture where necessary – do NOT spot clean.
- Ensure liquids are NOT left to pool on surfaces.
Warranty
Bluestone Furniture and Upholstery produces pieces of the highest quality. We know that every piece we create is built to last, so we are pleased to offer a 5-year warranty for all residential pieces and a 2-year warranty for pieces that are intended for commercial use.
Your warranty will not cover any variances or natural ageing that occurs due to inherent qualities of the materials used in the creation of your piece. Your warranty will also not cover general wear and tear including, but not limited to fading, tearing, scratching, chipping, dents, damage from pets or possible changes in colour. It is at our sole discretion to determine whether or not a particular defect will be covered under warranty.
We reserve the right to request photographs, or inspect your product in person, before making a determination as to a claim under warranty. Warranties will be voided if proper attention is not paid to the care instructions.
We reserve the right to refuse to uphold your warranty if we deem your piece as having not been properly cared for in accordance with any relevant care instructions. This is at our sole discretion. Your warranty time will commence from the date that you receive your piece of furniture.
Lead times
The time it will take to have your piece created and delivered will vary from order to order. A timeframe relative to the payment of your deposit will be discussed at the time of placing your order. We always endeavour to comply with suggested lead times and have your piece ready for you on the agreed completion date.
We cannot be held responsible for delays that stem directly from circumstances beyond our control. Depending on the time of year and what projects we have in the pipeline, our lead time is usually 8-10 weeks after deposit, however can go out to 18 weeks leading up to Christmas.
How do you work out lead time?
Our lead time is basically a queue. Once we have received your deposit, we pencil your spot in the queue. Changes to the design of your furniture and additional inspections of the furniture during manufacture will also add to the lead time for the completion of your order.
Please note: Lead time is an estimate only.
Our lead time is just a guide rather than being exact. The date we give you is an estimated date of completion rather than guaranteed completion date. Many things can happen that may put us behind in our production schedule such as illness, unscheduled staff holidays, delays in fabrics and materials, and projects taking a lot longer than originally estimated. For one-off custom-made pieces and large inbuilt projects however, we can only estimate how long they will take to make, unexpected variations can throw out our production schedule.
Storage
If, for whatever reason, you are unavailable to accept delivery of your products on the agreed estimated delivery date, we reserve the right to charge a storage fee of up to $10 per day, for each day that we store your piece at our premises. The amount accrued will be added to your balance and will become due at the time of delivery.
Cancellation, refunds & exchanges
Because a lot of love and work goes into all our pieces, we are unable to accept cancellations of orders. You will forfeit your deposit paid if you cancel your order at any stage after manufacturing has commenced. If you cancel your order after we have commenced manufacturing your piece, you may be liable to pay a cancellation fee of anywhere up to the full purchase price. This determination will be made at our discretion, based on the stage of manufacture that we are at, and the materials that have been sourced. We are unable to provide refunds or exchanges for change of mind. Please select your items carefully.
Material costs
Bluestone Furniture and Upholstery products are manufactured from high quality upholstery supplies and natural materials such as sustainably sourced timbers. Natural materials are subject to fluctuations in market price and availability that are beyond our control.
In the instance that your chosen materials are subject to an unanticipated increase in cost or a significant delay due to circumstances out of our control after you have placed an order with us, Bluestone Furniture and Upholstery reserves the right to increase our selling price to you to cover the cost of the market price increase. Should this occur, Bluestone Furniture and Upholstery will re-quote your furniture to confirm the new price. You will have the right to request your deposit be returned less any time or material costs that have already been allocated to your order if you do not accept to the new quoted fee.
We do our best to advise customers of the suitability of fabrics, whether supplied by us or not, however, we can take responsibility for materials which are supplied by us ONLY; covering fabric supplied by the customer is at their own risk. Shortage of covering fabric supplied by the customer is, likewise, the customer's responsibility.
- We reserve the right to apply a 15% surcharge for handling fabrics not supplied by us.
- There will be a surcharge if we are given many small pieces from which to make a product.
- We cannot be held responsible for fabric flaws. If we cannot cut round them, you will be notified.
- Where printed and woven fabrics will not pattern match accurately, we will inform you for further discussion.
- We reserve the right to add a surcharge to the make-up costs where fabrics, woven or printed off-grain, require extra time to make and where fabrics and patterns behave unexpectedly.
- We cannot be held responsible for the present or future behaviour of the treatment/fabric/trims, such as wearing and deterioration, stretching, shrinking, staining, cleanability, fading or damage to person or property, where the consumer has acted against the manufacturer's/retailer's instructions i.e., washing instructions, steaming etc.
Intellectual property and design ownership
With respect to our website content, whilst we make it available to everyone, all the designs, images, photographs, illustrations, logos, text, HTML code or any other intellectual property content remain the property of Bluestone Furniture and Upholstery.
Your use of our website is allowed, under the proviso that we retain, at all times, copyright ownership of any original website content. This content, therefore, may not be reproduced, re-published or in any other way disseminated (in whole or in part) without our authorization and express consent.
The gathering, storing, printing or copying of any of our intellectual property content, may be permitted for personal or individual use. The use, however, of any of the intellectual property made available through our website or designs, in relation to the advancement of any business or commercial venture is strictly forbidden.
With respect to designs, Bluestone Furniture and Upholstery retains ownership over any design created for any person, including retail customers. If, however, in your capacity as a designer, you have provided us with a design, you will retain ownership of this material, and permit us a license to use it for an agreed purpose.
Where you have requested particular design features in your piece, you take responsibility for those features. Bluestone Furniture and Upholstery will not be liable for any copyright or other infringement based on these features, and you indemnify Bluestone Furniture and Upholstery for any claims arising from alleged infringement.
Persons found to be misusing any of Bluestone Furniture and Upholstery's intellectual property, may face penalties. Furthermore, we reserve the right to prohibit from using our service, anyone whom we deem as having contravened intellectual property guidelines.
Marketing
Bluestone Furniture and Upholstery regularly shares photos and videos of our products in our marketing channels, including our social media profiles and website.
By accepting our quote, you are consenting to having your products photographed in our studio and your home and featured on our social media channels. If you do not consent to your Bluestone Furniture and Upholstery products featuring in our marketing materials, please advise us when placing your order and we will respect your wishes.
Links to third party websites
Bluestone Furniture and Upholstery may occasionally make third party links available via our website. Following any such link is at the individual's discretion. We do not govern, nor do we police the activities or policies of any third-party website we may make available.
We will not be held responsible for any loss or damage incurred as a result of the use or misuse of any third-party website. You should always carefully read the policies in place before engaging with third party services.
Feedback
We love hearing feedback on our service and creations from happy customers. If you chose to provide us with feedback, we may re-produce this, in whole or in part, on our website. Your feedback may be edited for length and clarity. You will not be fully identified.
If you do not wish for us to share your feedback with other users, or if you wish to remain completely anonymous, please let us know at the time that you share such feedback with us.
Acceptance of terms
When accepting a quote for a custom piece, we will assume that you understand and agree to our Terms and Conditions. Once your deposit has been received you will remain bound by the content within it. No adjustments or variations may be made to this document, unless expressly agreed upon, ahead of time, by Bluestone Furniture and Upholstery and you.
Liability and indemnity
To the maximum extent permitted by law, Bluestone Furniture and Upholstery cannot be held liable for any loss or damage that users may suffer as a direct or indirect result of accessing our website. This includes but is not limited to: special or consequential loss, loss of data, loss of savings, loss of opportunity or loss of profits.
To the maximum extent permitted by law, Bluestone Furniture and Upholstery will not be held liable for any injury, illness or negative health outcome resulting from, or related to, the use of furniture produced and/or upholstered by us. This includes not only direct physical injury by fall, impact, smothering, or other means, but other medical events such as asthmatic response or allergic reaction, as well as any psychological impact resulting therefrom or otherwise. Bluestone Furniture and Upholstery will endeavour to best accommodate any health needs as best as we are able, and we encourage you to communicate to us any special requirements around materials and your health, but we offer no guarantee and no acceptance of responsibility for any of the above mentioned adverse health outcomes.
Reliance
We provide information through our website for general use and purposes only. In providing this information, Bluestone Furniture and Upholstery is in no way guaranteeing its accuracy, completeness or reliability. Should you choose to rely on the information provided throughout this website, you do so at your own risk and are thus responsible for any consequences of doing so.
Whole of terms and conditions
This document comprises the whole of the Terms and Conditions, which govern the relationship between Bluestone Furniture and Upholstery and our customers. With the exception of our Terms and Conditions accepted when placing an order, no other Term, Condition, Warranty or Inference is intended to apply, other than those expressly implied by Australian or State consumer law, or any other applicable piece of legislation.
We reserve the right to make changes to our Terms and Conditions, at any time, without notice or consequence. Any changes will be published here and will take immediate effect from their time of publication. It is the responsibility of the user to make sure they are up to date with our Terms and Conditions.
